Terms of Service

These Terms of Service ("Terms") govern your use of Luca (the "Service", "we", "us", "our").

By creating an account, you agree to these Terms, our Privacy Policy, and our AI Transparency Notice.

1. Service Description

Luca is a personal finance dashboard that:

• Connects to your bank accounts via open banking (read-only access)
• Allows manual transaction entry and CSV import
• Uses AI to categorize transactions based on categories you define
• Optionally provides generic savings suggestions
• Sends configurable spending alerts

What the Service is NOT

• Luca is not a financial advisor and does not provide regulated financial advice
• We do not initiate payments, execute transactions, or move money
• We do not evaluate creditworthiness, affordability, or eligibility for any financial product
• We do not guarantee any savings, returns, or financial outcomes
• AI-generated suggestions are generic, informational, and optional

2. Beta Program

Luca is currently in beta:

• The Service is provided free of charge
• Access is by invitation only
• Features may change or be removed without notice
• The Service may contain bugs, errors, or inaccuracies
• We provide the Service on an "as is" and "as available" basis

3. Eligibility

To use Luca, you must:

• Be at least 18 years of age
• Have a valid email address
• Have legal capacity to enter into these Terms

4. Account Responsibilities

You are responsible for keeping your account credentials secure and for all activity under your account.

5. Bank Connectivity

Bank connectivity is provided through Enable Banking, a third-party open banking provider. We access your bank data in read-only mode. Bank connections may expire and require reconnection. You can disconnect at any time.

6. AI Features

• AI categorization is provided for convenience and may not be accurate
• You can review, edit, or disable AI categorization
• AI financial analysis (when enabled) is automated output based on the data and preferences you provide — it is not regulated financial advice and must be verified before acting
• You are solely responsible for any financial decisions you make

7. Acceptable Use

You agree not to use the Service for illegal purposes, attempt to access other users' data, reverse engineer the Service, or upload malicious content.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed EUR 100. We are not responsible for inaccurate AI outputs, banking data issues, or decisions you make based on the Service.

Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

9. Your Data

You can delete your account and all data at any time, export your data, and disconnect your bank. See our Privacy Policy.

10. Termination

You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms or discontinue the Service with reasonable notice.

11. Changes to These Terms

We may modify these Terms from time to time. Material changes will be notified at least 14 days before taking effect.

12. Governing Law

These Terms are governed by the laws of Spain. Disputes shall be submitted to the competent courts of Spain, without prejudice to mandatory consumer protection provisions.
